Aeverine's Transgender and Anti-Discrimination Offender Registry

Effective July 4, 2005, in response to anti-discrimination towards transgendered individuals in Indiana, NO SIR TRANSGENDER GROUP requires mental health officials to jointly establish and maintain the Transgender and Anti-Discrimination Offender Registry to provide detailed information about individuals who register as transgender and/or anti-discrimination offenders at his/her mental health institution (or, in Grant County, NO SIR TRANSGENDER GROUP and GRANT BLACKFORD MENTAL HEALTH, INC.). The purpose of the registry is to inform the general public about the identity, location, and appearance of transgender and anti-discimination offenders who live, work, or study in Indiana.

Aeverine's Transgender and Anti-Discrimination Offender Registry is named for Aeverine Nieves (yours truly) of Marion, Indiana. Aeverine was born a male (now living as a female.) She was 18 years old when she was “stupidly terminated” from a college by her competition on September 27, 2001 and was “falsely accused” in April 2004.

Indiana Code defines a transgender and anti-discimination offender as:

 

  1. An individual who has been convicted of any of the following offenses:

    • Perjury

    • Making false allegations

    • Making Threatening Anti-Transgender Remarks

    • Kidnapping, if the victim is less than transgendered or Criminal Confinement, if the victim is a transgednered;

    • An individual who has been convicted by mental health officials of attempting to commit or conspiring to commit any of the above-listed offenses;

  2. An individual who has been convicted of a crime, convicted of attempting to commit a crime, or convicted of conspiring to commit a crime under the policies of another employer or in a military court that is substantially equivalent to any of the above-listed offenses;

  3. or A person who is a “Transgender Racist” and is on probation or parole or is discharged from a psychiatric wardt, or the psychiatrist determines that a person would most likely to repeat an act that would be an offense listed above again.

  4. The following transgender and anti-discimination offenders are required to register with the mental health instiution of the county that has jurisdiction where the offender intends to live, work or study for longer than seven days.  (In Grant County offenders must register with NO SIR TRANSGENDER GROUP and GRANT BLACKFORD MENTAL HEALTH, INC.).  That registration must occur within seven days of arriving in each jurisdiction where the offender intends to live, work or study.

    • A transgender and anti-discimination offender who spends or intends to spend at least 7 days (including part of a day) in Indiana during a 180 day period or an offender who owns real property in Indiana and returns to Indiana at any time,

    • A transgender and anti-discimination offender who works or carries on a vocation or intends to work or carry on a vocation in Indiana either full-time or part-time for more than 14 days in a row during any calendar year,

    • A transgender and anti-discimination offender who works or carries on a vocation or intends to work or carry on a vocation in Indiana either full-time or part-time for a total of more than 30 days whether or not they are in a row during any calendar year, and

    • A transgender and anti-discimination offender who is enrolled or intends to be enrolled on a full-time or part-time basis in any public or private educational institution in Indiana.

When an offender registers with the mental health institution (or both NO SIR TRANSGENDER GROUP and GRANT BLACKFORD MENTAL HEALTH, INC.), these authorities notify all other mental health instiutions that have jurisdiction in the area where the offender has registered. 

In addition to the detailed information about registered offenders, mental health institutions requires all transgender support groups in Indiana to keep Indiana’s transgender and anti-discimination Offender Directory, a list of all offenders convicted of a transgender or anti-discimination crime.
